Welcome to ChargeDock Plus! These Terms of Service ("Terms") govern your access to and use of the website https://chargedockplus.com (the "Site") and the products and services offered by ChargeDock Plus ("we," "our," or "us"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

1. Acceptance of Terms

By accessing and using our Site, you acknowledge that you have read, understood, and agree to be bound by these Terms, including our Privacy Policy, Refund Policy, and Shipping Policy. These Terms constitute a legally binding agreement between you and ChargeDock Plus.

2. Eligibility

You must be at least 18 years old to use this Site and purchase products. By using the Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. Account Responsibilities

If you create an account on our Site, you are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to terminate accounts, refuse service, or cancel orders at our sole discretion.

4. Product Descriptions and Pricing Accuracy

We strive to provide accurate descriptions and images of our products, including the "ChargeDock Plus" Acer 7 in 1 Wireless Charging Station. However, we do not warrant that product descriptions or other content on the Site are accurate, complete, reliable, current, or error-free. All prices are subject to change without notice. In the event of a pricing error, we reserve the right to cancel any orders placed for the product at the incorrect price.

5. Order Acceptance and Cancellation Rights

Your placement of an order does not necessarily assure our acceptance of your order. We reserve the right to refuse or cancel any order for any reason, including limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. If your order is canceled after your credit card has been charged, we will issue a credit to your credit card account in the amount of the charge.

6. Payment Terms

All payments are due at the time of order placement. We accept various payment methods as indicated on the Site. By submitting your payment information, you represent and warrant that you are authorized to use the designated payment method and authorize us to charge your payment method for the total amount of your order, including any applicable taxes and shipping fees.

7. Intellectual Property

All content on the Site, including text, graphics, logos, images, product names (e.g., "ChargeDock Plus"), and software, is the property of ChargeDock Plus or its content suppliers and is protected by intellectual property laws. You may not use, reproduce, distribute, or create derivative works from any content on the Site without our express written permission.

8. User Conduct

You agree not to use the Site for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Site. You agree not to attempt to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to the Site, through hacking, password mining, or any other means.

9. Limitation of Liability and Disclaimer of Warranties

THE SITE AND ALL PRODUCTS AND SERVICES DELIVERED TO YOU THROUGH THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CHARGEDOCK PLUS DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

IN NO EVENT SHALL CHARGEDOCK PLUS, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, INTERNS, SUPPLIERS, SERVICE PROVIDERS, OR LICENSORS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICE OR ANY PRODUCTS PROCURED USING THE SERVICE, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICE OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICE OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICE, EVEN IF ADVISED OF THEIR POSSIBILITY.

10. Indemnification

You agree to indemnify, defend, and hold harmless ChargeDock Plus and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

11. Governing Law and Dispute Resolution

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the state of California, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in California.

12. Severability Clause

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
